WEDNESDAY 17 DECEMBER 2008


According to articles (59 / 2) and (109) of the Constitution, to meet public interest in establishment of a democratic federal political system based on justice, and to promote the role of the Iraqi Council of Representatives in achieving regulatory and legislative role and its efforts to unify Iraqis` word and to assist in the development of democratic and constitutional institutions , and reassure everyone that the country is on the shore of security, peace and stability , and protect the rights of citizens and freedom of expression and opinion, conduct fair elections and peaceful transfer of power , and the separation of powers, and constitutional and political participation, respect the Constitution and laws and the principles of national consensus, and the policy of national reconciliation and to get back full sovereignty rights, to recover all types of powers to a prosperous, united and free Iraq, so that it can rejoin the international community and start practical procedures to get Iraq out of Chapter VII of UN agreement, taking into consideration the protection of its assets and oil sales,


The COR has decided the following:-



1. Emphasis on all state institutions and parliamentary blocs abide by the constitution and all its articles and basis reducing purposed selection and explanations, as well as commitment to legal and administrative contexts and the state unity and the unity of the policies in accordance with regulations and laws: and the differences between the state institutions or parliamentary bloc can not be decided by imposing one opinion but by judicial, legislative and administrative institutions and the constitutional amendments in accordance with current laws must take place according to contexts ratified by the Constitution and laws, and not by any other contexts.
2. Follow-up the Iraqi government with the U.S. side to consider the points raised by the Iraqi side from either the government or the parliament, which can be adjusted according to the mechanics of the deal, especially with regard to jurisdiction and ensure to get out of Chapter VII and the protection of Iraqi assets and the implementation of the Convention and a real partnership of various federal authorities to follow up the implementation of the Convention. And limit the role of Iraqi and U.S. forces in defending the security, the fight against terrorism and those who are against the law, self-defense and prevent their use in internal conflicts within the framework of the Constitution and the awareness of this principle, As well as to prevent any part to use these conflicts to impose the policy of defacto, far from the constitutional contexts.
3. Wok as hard as possible to strengthen the independence and sovereignty of Iraq and prevent any foreign interference in its affairs.
4. The COR demands the relevant sides to achieve the following;-

a) Release all detainees who included the Amnesty Law No.19 of 2008.

b) Work together for amendments to the constitution to ensure Iraq's stability and to preserve the unity, sovereignty and its federal democratic foundations. Complete a series of Bills that have a direct connection to the stability of the situations in Iraq and terminate all kinds of instability in legal reference or conflict and interference of specializations.

c) The principle of participations and consensus has its constitutional and political basis that must be achieved in word and deed to reassure everyone with no exceptions. And emphasis the importance of work and sharing in the executive and legislative institutions, in particular the COR, the Presidency and the Cabinet in accordance with the rules of procedures and Laws and abide by the legal authorities and not to interfere in the affairs of institutions, authorities and ministries out of internal regulations and legal contexts.

d) Respect the specializations and authorities of Federal government, Regional government and Local government in accordance with the Constitution.

e) A general balance, especially in the security, economic and Foreign Service institutions, in accordance with the Constitution with equal opportunities for all. And cancel all institutions and non-constitutional boards or rehabilitee them and rebuild the armed forces and state security services on national and professional basis , away from any political form, based on a reform plan submitted at the earliest possible opportunity.

f) Follow up the investigations on issues concerning the file of human rights and detainees without legal procedures and work to release those who detained by US forces or Iraqi authorities.

g) End the file of the emigrants outside and inside Iraq and work hard to find solutions to take care of them or to get them back to their residence and encourage the competences to return by issuing appropriate regulations.

h) Absorb Sahwa elements and join its members to armed forces or state departments or rehabilitee them according to a governmental program, taking into account the above point e and stop prosecution them except those who committed crimes against Iraqi people.

i) Absorb the armed groups who drop weapons or ready to, and bring them to the political process through a national program agreed upon.

j) Ensure the integrity or independency of the judiciary from the executive.

k) Ensure the integrity and transparency of the elections.



5. a) COR studies the amendments or replacement or cancelling the Laws rejected by parliamentary blocs in accordance with its rules of procedures and the benefits of the next stage based on the achievements of national reconciliation.

b). Resolve differences over the issue of presidential decrees issued in the implementation of death sentences in accordance with the Constitution and the independence of the judiciary.

c) Define the consultant, the political and the legal position of the Political Council of the National Security.

6. Fulfill the demands of the political blocs in accordance with its benefits in the state institutions on positions of deputies of ministries, heads of boards and special degrees and the COR shall accelerate the ratification on the special degrees.

7. COR presidency shall follow up the implementation of the above items.

8. This Resolution is effective from the date of publication in the Official Gazette.
