Announced the government spokesman Ali al-Dabbagh said the Cabinet decided to approve the draft Law on the accession of the Republic of Iraq to the International Convention for the Suppression of Acts of Nuclear Terrorism adopted by the United Nations and referred to the House of Representatives based on the provisions of Articles (61 / item first, and 80 / item II) of the Constitution.




Dabbagh said that the approval of the draft Law on the accession of the Republic of Iraq to the International Convention for the Suppression of Acts of Nuclear Terrorism comes in line with the government shift to contain what may cause damage by nuclear terrorism and its consequences as the obligation in the legislation of laws to deter perpetrators of this kind of terrorism would be a collar to secure the safety of society and cities from the effects of radiation and Mspbhe The convention aims to achieve the purposes of the United Nations Charter and principles of peacekeeping and security and promoting good-neighborly relations and friendly relations and cooperation between States in the fight against nuclear terrorism and reduce the escalation of terrorist acts.




Dabbagh said that the International Convention for the Suppression of Acts of Nuclear Terrorism was based on the report of the Ad Hoc Committee which was established by a decision of the General Assembly of the United Nations, which was issued on 17 December 1996 have been approved by the United Nations in 13/4/2005 and entered into force on 7 / 7 / 2007, where previously the Ministry of State for National Security, requested from the State Consultative Council to advise regarding the accession to the Convention has been scrutinized by the State Council of the Convention and stated in its advice to the Ministries of Foreign Affairs, Defence and Interior and the Ministry of State for National Security Affairs supports all acceding to the Convention and the Ministry of Science and Technology indicated that accession to the Convention opens the prospects for cooperation with Member States for information and technical expertise, where the Convention provides that each State Party to the Convention the necessary measures that would make the offenses mentioned crimes under national law, and make perpetrators liable to appropriate penalties which take into account the of those offenses of a serious nature and enactment of domestic legislation does not make criminal acts within the scope of this Convention acts are justified in any way by considerations of a political, philosophical, ideological, or any other similar nature, where States parties to cooperate to take all possible measures necessary to prohibit persons groups and organizations in their territories illegal activities encourages the commission of those crimes or incite to commit, and to exchange accurate and verified information in accordance with national law and to maintain the confidentiality of any information obtained by the States Parties shall inform the Secretary-General of the United Nations of their competent authorities and liaison points responsible for sending and receiving information on this matter.




Dabbagh said that anyone who unlawfully and intentionally possess radioactive material or makes or possesses a device intended to cause death or serious bodily injury or intended to cause substantial damage to property or the environment, he commits a crime is an offense to use any radioactive material or device radiator or use a nuclear facility or damages a manner conducive to the release of radioactive material threaten lives and damage to property or the environment or with intent to compel a natural or legal person, international organization or State to do or abstain from doing well is all those who contributed as an accomplice to a crime that is the perpetrator of the crime and is a criminal anyone who organizes or directs others to commit such crime, or even contribute in any way by a group of persons acting with a common purpose to commit one of those crimes where the States Parties shall make every effort to adopt appropriate measures to ensure the protection of materials radioactive taking into account the recommendations and the relevant tasks of the International Agency of Atomic Energy and at the stone materials or devices radioactive materials or nuclear facilities or control following the commission of an offense under the State party take action to bring radioactive material or device irradiated harmless and to ensure that any nuclear material, according to with applicable safeguards of the International Atomic Energy Agency and if the materials or devices not owned by any of the States Parties or a citizen of a State Party or a resident or were not stolen or obtained illegally, it is a separate decision on how to dispose of the States Parties had requested the assistance and cooperation of other parties to act in the radioactive material, device or nuclear facility or to keep her to be notified by the Director General of the International Agency for Atomic knocker way that would be disposed of or retained.
