This is an update on the status of UNAMI and Chapter VII. The UNAMI mission is not under Chapter VII. A Chapter VII resolution requires a statement that the Security Council is “Acting under Chapter VII”.

Several months ago, during one of my research bouts on Chapter VII resolutions and Security Council protocol, I received considerable information from two UN representatives. The research was for another post I made back then. Part of the information is listed below. UNAMI is a political/humanitarian mission with some long term projects that go out to 2013. UNAMI will be around for a long time after Chapter VII finally does go away. There was a prior program in place before UNAMI. It was UNIKOM and it was enacted under Chapter VII. It started with Resolution 689 (1991) and terminated under Resolution 1490 (2003). Don't confuse the two programs. Please note that both these resolutions are listed in the Chapter VII resolutions at the bottom of this post.

The first link is a UNAMI public document that lists the resolutions that affected UNAMI up to the time of its publication. I was informed by the UN representative that the resolutions listed in this document provided the status on which resolutions were under Chapter VII and which were not. Note that the UNAMI resolutions do not carry the phrase “Acting under Chapter VII”.

I was also provided access to a research paper entitled “An Analysis of the Increased Resort to Chapter VII by the UN Security Council in the Post-Cold War Era”. This document discusses the conditions and terminology required for a Chapter VII resolution. The following is an excerpt from this document:

“Recalling or reaffirming a previous resolution adopted under Chapter VII is not enough to make a Chapter VII resolution. A statement that the SC is acting under Chapter VII is required.”

Within this document is also an attachment that lists all the Chapter VII resolutions by country up to 2007. I extracted the Iraq section. Please note that the UNAMI resolutions, (1500, 1557, 1619, 1700, 1770) are missing from this list.
