الدباغ: الموافقة على مشروع قانون إنضمام العراق الى إتفاقية الحماية المادية للمواد النووية Dabbagh: Approved a draft law on Iraq's accession to the Convention on the Physical Protection of Nuclear Material
أعلن الناطق الرسمي بإسم الحكومة العراقية علي الدباغ أن مجلس الوزراء قرر الموافقة على مشروع قانون إنضمام جمهورية العراق الى إتفاقية الحماية المادية للمواد النووية المعتمدة من قبل الأمم المتحدة وإحالتها الى مجلس النواب إستناداً الى أحكام المادتين (61/البند أولاً و80/البند ثانياً) من الدستور. Announced the government spokesman Ali al-Dabbagh said the Cabinet decided to approve the draft Law on the accession of the Republic of Iraq to the Convention on the Physical Protection of Nuclear Material, adopted by the United Nations and referred to the House of Representatives based on the provisions of Articles (61 / item first, and 80 / item II) of the Constitution .
وأشار الدباغ الى أن الموافقة على مشروع قانون إنضمام العراق الى إتفاقية الحماية المادية للمواد النووية يأتي لإيفاء العراق بمتطلبات العمل بشفافية في هذا المجال وفق قرارات الحكومة بإنضمام العراق الى الإتفاقيات الدولية المختصة بمكافحة الإرهاب وما يتعلق بالحماية المادية للمواد النووية وتنفيذاً لتوصيات اللجنة المشكلة لدراسة موضوع رسالة الأمين العام للأمم المتحدة لتنفيذ العراق لقرارات مجلس الأمن الدولي بهذا الصدد ورفع قرارات مجلس الأمن ذات الصلة بأسلحة الدمار الشامل المتعلقة بالعراق وإخراج العراق من وصاية الفصل السابع حيث تهدف الإتفاقية الى ضمان التعاون الدولي في حماية الإستخدام السلمي والعسكري للطاقة النووية تفادياً للأخطار الناجمة عن إستخدامها أو إستعمالها بصورة غير مشروعة وإتخاذ التدابير اللازمة لمنع حدوث جرائم ذات صلة بالمواد النووية وتيسير النقل المأمون لها. Dabbagh said that the approval of a bill that Iraq's accession to the Convention on the Physical Protection of Nuclear Material comes to Iraq's fulfillment of the requirements to act transparently in this area in accordance with decisions of the government Iraq's accession to international conventions relevant to combating terrorism and the physical protection of nuclear materials and implement the recommendations of the committee formed to study the letter of the Secretary General of the United Nations for Iraq to implement UN Security Council resolutions in this regard and with relevant Security Council resolutions relating to weapons of mass destruction on Iraq and ousting Iraq from the tutelage of Chapter VII, where convention aims to ensure international cooperation in the protection of peaceful and military nuclear power in order to avoid the risks arising from their use or used in illegal and to take necessary measures to prevent crimes related to nuclear materials and to facilitate the safe transport them.
وأوضح الدباغ أن وزارة الدولة لشؤون الأمن الوطني سبق وأن طلبت من مجلس شورى الدولة إبداء المشورة القانونية بشأن الإنضمام الى إتفاقية الحماية المادية للمواد النووية وقد قام المجلس بتدقيق الإتفاقية حيث جاء في تلك المشورة أن وزارات الخارجية Dabbagh said that the Ministry of State for National Security Affairs had requested that the State Consultative Council to advise on legal accession to the Convention on the Physical Protection of Nuclear Material, the Board has audited the Convention, as stated in this advice to the Ministries of Foreign Affairs والدفاع والداخلية ووزارة الدولة لشؤون الأمن الوطني تؤيد جميعها الانضمام الى الإتفاقية وبينت وزارة العلوم والتكنولوجيا أن الانضمام الى الإتفاقية يساهم في الأمن والأمان النوويين ويفتح آفاق التعاون مع الدول الأعضاء في الحصول على المعلومات والخبرات التقنية وكذلك تأمين الطرق الخاصة والمحمية عند نقل المواد أو مرورها عبر البلدان. Defence and Interior and the Ministry of State for National Security Affairs supports all of the Convention and indicated the Ministry of Science and Technology accession to the Convention contributes to the safety and security of nuclear and opens prospects for cooperation with Member States to obtain information and technical expertise as well as securing private roads and protected when you move the material or transit through the countries.
وأضاف الدباغ أن الإتفاقية قد تم إعدادها من قبل ممثلين عن (58) دولة وقد إعتمدتها الأمم المتحدة في 3/3/1980 ودخلت حيز النفاذ في 8/2/1987 وتضمنت الإتفاقية عدة مواد تعالج موضوع الحماية المادية للمواد النووية حيث أن كل دولة طرف في الإتفاقية يتوجب عليها أن تتخذ الخطوات المناسبة في إطار قانونها الوطني وبما يتفق مع القانون الدولي لضمان أقصى حد ممكن عملياً أثناء النقل النووي الدولي وأن توفر الحماية على المستويات المبينة في الاتفاقية Dabbagh said the agreement had been prepared by representatives of (58) state has been adopted by the United Nations in 3.3.1980 and entered into force on 8/2/1987 and the agreement included several articles dealing with the physical protection of nuclear materials that each State Party to the Agreement also needs to take appropriate steps under its national law and consistent with international law to ensure the maximum extent practicable, during international nuclear transport and to provide protection at the levels set forth in the Convention ولها أن تتخذ قرار بالتصدير أو عدمه ما لم تتلقى تأكيدات بأن المواد ستكون محمية أثناء النقل النووي الدولي وكذلك بالنسبة للإستيراد فلا يجوز لأية دولة طرف بأن لا تسمح بعبور أراضيها عن طريق البر أو في الممرات المائية أو عن طريق المطارات أو الموانئ الى الدول التي ليست طرفاً في هذه الإتفاقية ما لم تكن الدولة الطرف قد تلقت تأكيدات بان هذه المواد سوف تكون محمية أثناء النقل النووي الدولي It may take the decision to export or not what you do not receive assurances that the material will be protected during international nuclear transport as well as for import is not permissible for any State Party that does not allow to cross its territory by land or in waterways or through airports or ports to the countries that are not party in the present Convention were not the State Party has received assurances that these materials will be protected during international nuclear transport
