I had heard that if they fly that it will cancel out the VII. but that is heresay.. I know everyone is getting burned out but I still and will continue to have hope in this

The airlines lawsuit against Iraq did not involve the UN or Chapter VII. Kuwait filed in Britain and Canada. Terminating Chapter VII still requires Iraq to resolve all the outstanding issues with Kuwait (missing persons, missing archives, borders and compensation). The Secretary General is considering an option that would move the outstanding issues from Chapter VII to Chapter VI and would be under UNAMI. Considering what is happening in Iraq right now with the political instability and all the bombings that may not happen. The Security Council may decide to continue to use the excuse of the Kuwait issues to keep Iraq under Chapter VII.

Yes, they did, that resolved the lawsuit which is why the flights started again.

When Iraq went under Chapter VII in 1990, restrictions were applied to all flights in and out of Iraq and Kuwait from any country. The only flights that were allowed were for humaniterian reasons. Same for ships. This restriction also applied to trade between Iraq-Kuwait and all other countries. Those restrictions were lifted years ago.

The only issues left under Chapter VII are borders, archive, missing persons and compensation.

They are "supposed" to have all the borders marked by the end of March, but as we've seen time and tine again, they talk a good game, but when it comes to meeting any deadline, well... you all know their track record. Don't hold your breath or get excited just yet....

I am hearing elsewhere that the flights nallify chap VII, and everything else falls under Vi, saposed to be something in the iraqy or kuwait law's.

Not true, the only way Chapter VII can be removed is by a vote of the Security Council. The Security Council Chapter VII resolutions are legal documents. The outstanding issues (compensation, borders, missing persons and property) are controlled by the Chapter VII resolutions. Until the Security Council votes on a new resolution that changes the status of these issues from Chapter VII to Chapter VI, Chapter VII is still in effect. Iraq and Kuwait law do not have any impact on the authority of the Security Council. The flight of an aircraft has absolutely nothing to do with the legal process of Chapter VII.

There are a lot of individuals who are posting information who are clueless regarding the legal process of Chapter VII resolutions.
